The Food Safety and Standards Authority of India (FSSAI) on Thursday said it has issued notices to Dr. Reddy’s and Nestle Health Science Ltd besides Flipkart India, Amazon India, Netmeds Healthcare and Tirupati Wellness Pvt Ltd over alleged non-compliant claims and ads regarding a nutritional supplement. The regulator said the notice was issued regarding “non-compliant advertising and claims for “Celevida GLP+” on e-commerce platforms.”
In a social media post, the regulator said the product was found to be advertised as “High protein support for lean muscle preservation during GLP1/GLP therapies”. “Such claims were found to imply suitability for a specific physiological condition. The brand name “Celevida GLP+”, along with the GLP-1/GIP therapy-related claims, was found to create a misleading association between the product and such therapies,” FSSAI added.
It added that claims of “Help Maintain Lean Muscle”, “support muscle strength” and “preserves lean mass” were found “to imply that the product may help mitigate loss of lean body mass during weight loss and GLP-1/GIP therapy.”
The regulator said that certain claims made by the product such as “complete daily nutrition” potentially portrayed that it is a “complete nutrition product or meal replacement.”
“The representation “Imported from Europe for purity” was found to be misleading, as European origin by itself does not establish enhanced or superior purity of the protein.The claim “Contains 100% RDA BCAA” was found to be ambiguous and misleading. FSSAI has also directed FBOs to discontinue the use of the term “100%” on food labels, packaging and promotional content,” the regulator noted.
FSSAI also said the disclaimer on the product “that it is only a brand name and does not represent its true nature” was not sufficient to negate misleading impressions created by the overall presentation of the product among other concerns.
“The concerned FBOs have been directed to show cause as to why action should not be initiated under the FSS Act, 2006,” FSSAI’s social media post added.
In a separate enforcement action, FSSAI has also suspended the licence of Shreyas Retail for repeatedly being involved in the sale of expired or rotten food products. “FBO was found repeatedly involved in the sale of expired or rotten food products, with more than 70 consumer complaints specifically relating to such instances. More than 130 consumer complaints/grievances were received against the FBO. In certain instances, consumers also reported vomiting after consuming expired/rotten food products,” it added in its social media post.
Meanwhile, the FSSAI has also sanctioned prosecution against Nex International over the issue involvins “unsafe loose raisins”
