The Food Safety and Standards Authority of India (FSSAI) has initiated penal action against key e-commerce and quick commerce platforms for sale of products that were found to be non-complaint with regulations.
The food safety regulator on Wednesday said there has been “a major crackdown on e-Commerce platforms including Amazon, Swiggy Instamart, BigBasket, Flipkart India and Zepto over regulatory non-compliances.”
In a social media post, FSSAI said that “a penal action” has been initiated for sale of products that were found to misbranded or making misleading claims as well as for with for sale and display of prohibited or poisonous food articles through their platforms.
The regulator pointed out that Happilo Premium Date Bites, Zesty Orange and three products of Milky Mist, being sold on the platforms, were found to be non-compliant due to misleading and non-complaint claims and non-compliant product information.
In the case of Amazon Seller Services, FSSAI said, it has initated penal action for the sale of brand Happilo Premium Date Bites (Zesty Orange) through its platform as it was found to be displaying misleading and non-compliant claims.
Also for the sale of dhatura fruits and seeds, which the regulator said was non-compliant with provisions of the FSS Act, 2006, which pertain to sale, display and offer for sale through e-commerce platforms. It has also initiated action against Flipkart India and Zepto for the sale of the same product.
The food safety regulator said it has also initiated penal action against Swiggy Instamart for sale of products through its platform which were found to be non-compliant with the regulations.
This includes Happilo Premium Date Bites (Zesty Orange), Milky Mist Fresh Low Fat Cream, Milky Farm Fresh Curd and Milky Mist Greek Yoghurt, which were found to be displaying” misleading claims and non-compliant claims”, it added. The regulator also said that sale of dhatura seed or fruits through Instamart was in violation of its regulations.
Similarly, penal action has also been initiated against BigBasket (Innovative Retail Concepts Pvt Ltd) for the sale of Happilo Premium Date Bites (Zesty Orange), Milky Mist ‘s products including Fresh Low Fat Cream, Farm Fresh Curd and Greek Yogurt besides dhatura fruits or seed, FSSAI’s social media post noted.
The food safety regulator along with State FDAs have been intensifying their enforcement actions on food business operators and had recently also flagged concerns regarding e-commerce platforms, quick commerce platforms and cloud kitchens.
