The Supreme Court on Monday refused to entertain a PIL seeking contempt of court proceedings against BJP MP Nishikant Dubey for his remarks against the top court and CJI Sanjiv Khanna.
A bench of CJI Sanjiv Khanna and Justice Sanjay Kumar, however, said it will pass a short order. “We will be passing a short order but we will not be entertaining, we will express our views.”
The petitioner contended that the statements were not just scandalising the court, but also hateful and provocative.
The petitioner said that the SC Bar Association and entire legal fraternity has condemned it. “Don’t worry,” said the CJI reiterating that it will pass an order. The petition, seeking contempt of court proceedings, contended that “such acts amounts to an offence punishable under BNS and also under Section 15 of the Contempt of Courts Acts, 1971.”
Dubey in an interview to news agency ANI allegedly said, “CJI Sanjiv Khanna is responsible for all civil wars in this country.”
had distanced itself from Dubey’s remarks, with party chief J P Nadda saying, “The BJP has nothing to do with the statements made by BJP MPs Nishikant Dubey and Dinesh Sharma on the judiciary and the CJI…”
